Omarbetade kriterier för klassificering och märkning av farliga kemikalier
I december 2008 stadfäste EU en ny kemikalieförordning, den s.k. CLP-förordningen, som träder i kraft tisdagen den 20 januari 2009 och som efter en övergångsperiod kommer att ersätta EU:s nuvarande lagstiftning på området. CLP-förordningen (Classification, Labelling and Packaging of substances and mixtures) innehåller bestämmelser om klassificering, märkning och förpackning av ämnen och blandningar.
Förordningen innehåller bestämmelser om de kriterier som avgör om en kemikalie (ett ämne eller en blandning) klassificeras som farlig. Ett ämne som klassificeras såsom farligt kan t.ex. vara brandfarligt, giftigt eller miljöfarligt. CLP-förordningen innehåller också bestämmelser om hur farliga kemikalier ska märkas och förpackas för att risker vid användning ska elimineras. Varningsmärkningarna kompletteras med risk- och skyddsfraser samt signalord.
CLP-förordningen baserar sig på det globalt harmoniserade GHS-systemet för klassificering och märkning av kemikalier och EU:s gällande regelverk för klassificering, märkning och förpackning av farliga kemikalier. Förordningen är avsedd att säkerställa en hög skyddsnivå för människors hälsa och för miljön samtidigt som den ska medge fri rörlighet inom EU för kemikalier och vissa särskilda föremål som klassificeras enligt förordningen.
Ändringar även i nationella författningar
CLP-förordningen är direkt tillämplig i alla medlemsstater och upphäver efter övergångsperioder EU:s nuvarande rättsakter om klassificering, märkning och förpackning av farliga kemikalier, dvs. det s.k. ämnesdirektivet resp. beredningsdirektivet. Direktiven har i Finland verkställts genom kemikalielagen, kemikalieförordningen och vissa bestämmelser som ingår i förordningar utfärdade av social- och hälsovårdsministeriet. Efter övergångsperioderna upphävs även dessa nationella författningar.
Bland annat kemikalielagen ska kompletteras med bestämmelser om tillsyn över CLP-förordningen, om de nationella stöd- och informationspunkter (helpdesks) som anges i förordningen, om de behöriga myndigheterna samt om påföljder för överträdelser av förordningen.
