Sammandrag av remissyttranden: medling vid våld i nära relationer delar remissinstanser i förespråkare och kritiker
Myndigheterna förhåller sig i huvudsak positiva till medling, medan i synnerhet civilsamhällesorganisationer förhåller sig kritiska till medling vid våld i nära relationer. Dessa åsikter framgår av remissyttranden om ett förslag av en arbetsgrupp som har utrett medling vid våld i nära relationer.
Arbetsgruppen var tillsatt av den delegation för medling vid brott som finns i anslutning till social- och hälsovårdsministeriet, och gruppen fick sin rapport klar i januari. Arbetsgruppen har gått igenom nuläget i fråga om medlingen vid våld i nära relationer, medlingsprocessen och problem när det gäller medlingen samt lagt fram utvecklingsförslag. Arbetsgruppens utredning anknyter till den åtgärd i regeringen Sipiläs jämställdhetsprogram för 2016–2019 som gäller utredning av medling vid våld i nära relationer.
Social- och hälsovårdsministeriet sände rapporten på remiss och bad att få yttranden om den under tiden 6.2–28.2. Sammanlagt 48 yttranden lämnades.
De instanser som lämnat yttranden kan grovt indelas i två grupper. Den ena gruppen ser medling vid våld i nära relationer som en viktig och kompletterande del av straffprocessen, medan en del av remissinstanserna förhåller sig kritiska till våld i nära relationer. De flesta instanserna förutsätter att medlingen vid våld i nära relationer utvecklas på olika sätt.
Det behövs gemensamma kriterier för medling vid våld i nära relationer
Myndigheter såsom kommuner, polisen, åklagarämbeten och ministerier samt de medlingsbyråer som ansvarar för medlingen i praktiken förhåller sig i princip positiva till medling vid våld i nära relationer. Enligt förespråkarna är medling vid våld i nära relationer till fördel för medborgarna, och de anser att medlingen kompletterar straffprocessen vid våld i nära relationer.
I synnerhet många civilsamhällesorganisationer är kritiska till medling vid våld i nära relationer. Organisationerna menar att fall som inte borde gå till medling, dvs. fall där våld i en nära relation skett upprepade gånger och pågått länge, ändå frekvent går till medling. De är kritiska också på grund av att de anser att det vid medlingen inte finns tillräckligt god förståelse av dynamiken och de obalanserade maktförhållandena vid våld i nära relationer.
Remissinstanserna var trots åsiktsskillnaderna eniga om att processerna för medling vid våld i nära relationer bör utvecklas och de kriterier som används vid medlingen förenhetligas. I yttrandena betonades också att bekämpning av våld i nära relationer förutsätter mer förvaltningsövergripande samarbete än för närvarande. Remissinstanserna var också eniga om behovet av tilläggsutbildning för såväl medlingshandledare, medlare, åklagare som poliser.
