Utkastet till en ny lag om medling vid brott och tvister på remiss
Social- och hälsovårdsministeriet har skickat ut ett utkast till ny lag om medling vid brott och i vissa tvister på remiss. Målet med lagändringen är att säkerställa att medlingstjänster av jämn kvalitet hädanefter är tillgängliga för alla som behöver dem, oberoende av bostadsort.
Enligt lagförslaget skulle Institutet för hälsa och välfärd (THL) hädanefter ha det centraliserade ansvaret för ordnandet av medlingstjänster. För närvarande är ansvaret för ordnandet fördelat på flera regionförvaltningsverk. Genom att centralisera ordnandet av medlingstjänster skulle man göra det lättare att komma överens om och förverkliga gemensamma linjer för medlandet. Samtidigt skulle man bättre kunna utnyttja THL:s forskningsbaserade kunskap och utbildningskunnande.
Medlingen är en avgiftsfri tjänst där en brottsmisstänkt och ett brottsoffer ges möjlighet att mötas via en medlare under konfidentiella former. Syftet är att bearbeta de psykologiska och materiella skador som orsakats brottsoffret, samt att sträva till att på eget initiativ komma överens om åtgärder för gottgörelse.
Medlingsförfarandets lämplighet bedöms separat för varje brott. Vid bedömningen beaktas hur brottet begåtts, förhållandet mellan den brottsmisstänkta och brottsoffret samt övriga brottsrelaterade faktorer som en helhet.
Utkastet har beretts av en arbetsgrupp. Remisstiden löper ut den 29 oktober 2014. Det är meningen att regeringspropositionen överlämnas till riksdagen i december 2014 och att lagen träder i kraft den 1 januari 2016.
