Rökförbud eller separata rökutrymmen i restaurangerna
Direktören för Nylands regioninstitut för arbetshygien, professor Kari Reijula, som utrett hur bestämmelserna i tobakslagen tillämpas i restaurangerna, föreslår att tobakslagen ändras så att rökning förbjuds i alla restauranger eller att restaurangerna kan ha separata rökutrymmen utan servering.
Enligt Reijula kan man utgående från den riksomfattande utredning som Nylands regioninstitut för arbetshygien gjort konstatera att tobakslagen inte för restaurangernas del fungerar på önskat sätt. Ventilationstekniska lösningar är inte tillräckliga för att hindra tobaksrök från att sprida sig i utrymmena om man inte samtidigt går in för byggnadstekniska lösningar. Om restaurangsalen endast delas in i rökfria utrymmet och utrymmen där rökning tillåts, sprider sig röken till den rökfria delen trots ventilationen.
Enligt förfrågningar till arbetstagare och företagare har exponeringen för tobaksrök minskat mycket långsamt i restaurangerna: av alla restauranganställda hade 34 procent år 1999 inte exponerats för tobaksrök, år 2003 var motsvarande siffra 41 procent. Samtidigt minskade antalet anställda som exponerades för tobaksrök under mer än hälften av sitt arbetsskift (över 4 timmar) från 46 procent till 31 procent. Bland servitörer ökade antalet personer som inte exponerades för tobaksrök från 15 procent till 18 procent samtidigt som antalet anställda som exponerades över 4 timmar sjönk från 73 procent till 49 procent.
I synnerhet vid bardiskarna har man inte uppnått sådan rökfrihet som lagen förutsätter. Rökmängden i luften var hög vid bardiskarna under hela uppföljningstiden. Dessutom hade rökmängden vid bardiskarna ökat vid de senaste mätningarna åren 2003-2004. Fortfarande utsätts nästan 80 procent av barmästarna för tobaksrök under mer än halva arbetsskiftet. Det här tyder på att rökförbudet vid bardisken inte följs.
Restauranganställda är till följd av den gällande tobakslagen i en sämre situation än andra arbetstagare. På andra arbetsplatser fungerar tobakslagen och hindrar därmed exponering för tobaksrök. Enligt den gällande tobakslagen är det acceptabelt att de servitörer, som arbetar i den del av restaurangen där tobaksrökning är tillåten, exponeras för tobaksrök eftersom hälften av utrymmet fortfarande kan reserveras för rökare och det även serveras till detta utrymme. Till följd av detta exponeras tusentals arbetstagare fortfarande för tobaksrök i sitt arbete.
Enligt Reijula kan problemen inte lösas genom effektivare inspektioner av arbetarskydds- eller hälsoövervakningsmyndigheter, eftersom det i praktiken är svårt att övervaka verkställigheten av den gällande tobakslagen.
Omsorgsminister Liisa Hyssälä gav i juni direktören för Nylands regioninstitut för arbetshygien, professor Kari Reijula i uppdrag att utreda hur bestämmelserna i tobakslagen tillämpas i restaurangerna och hur personalen och kunderna exponeras för tobaksrök i restaurangerna.
