EU court rules on insurance procedures for special medicine categories
The European Court of Justice has ruled that Finland is in contravention of the EU’s directive concerning the transparency of measures that regulate decisions concerning insurance covering certain categories of medicine. The categories comprise those subject to a higher rate of health insurance cover.
During the case, brought in 2000, Finland countered that the EU’s transparency provision did not apply as it did not refer to medicinal products but to certain active ingredients in medicines. The court nevertheless found that Finland has failed to fulfil its obligations under the EU directive and that it will have to make the necessary adjustments to its decision procedures within health insurance
