Parliamentary reply EV 50/2022

Huumaantumistarkoituksessa käytettävien DMT:tä sisältävien tuotteiden sääntelyä täsmennettäisiin. Lupamenettelyä selkiytettäisiin. Viranomaisten mahdollisuuksia huumausainerikosten estämiseen, paljastamiseen ja selvittämiseen parannettaisiin ja muutoksenhakua koskevaa sääntelyä päivitettäisiin.

Goals and results

Esitys kytkeytyy hallitusohjelman tavoitteisiin hyvinvoinnin edistämisestä ja eriarvoisuuden vähentämisestä.

Starting points

Hanke on käynnistetty huumausainelaissa havaittujen täsmennystarpeiden vuoksi.

Esitykseen sisältyy lupamenettelyjä keventäviä ehdotuksia, jotka helpottaisivat luvanhakijoiden ja luvanhaltijoiden hallinnollista taakkaa.

Poliisin, Rajavartiolaitoksen ja Tullin mahdollisuudet estää, paljastaa ja selvittää huumausainerikoksia paranisivat, sillä esityksessä on tarkoitus ehdottaa, että jatkossa kyseisille viranomaisille voitaisiin myöntää sisäisesti lupa myös huumausaineen valmistamiseen sekä eräiden kasvien ja sienien viljelyyn. Tämä nopeuttaisi rikostutkintaa, sillä viranomaisten väliset lupamenettelyt poistuisivat. Tämä puolestaan parantaisi myös rikosasian vastaajan oikeusturvaa.
