Standard contract terms for public sector procurements

Standard contract terms for public sector procurements support the success of procurement processes. The standard contract terms promote compliance with legislation binding on public sector actors and support a successful procurement process. They facilitate social networking and create predictability in public procurement. This benefits both public sector contracting entities and suppliers of goods and services.

General terms of public procurement (JYSE)

The  general terms of public procurement (JYSE terms) maintained by the Ministry of Finance are used as standard terms in procurement contracts between contracting entities and suppliers concerning goods or services. The previous terms and conditions were published in 2014 and updated on the basis of feedback and needs assessment.
The public consultation carried out in late autumn 2024 produced nearly a hundred responses, on the basis of which the terms and conditions were finetuned. The JYSE 2025 conditions were published (in Finnish and Swedish) in May 2025.

General terms of public sector IT procurement (JIT)

The General Terms and Conditions of Public IT procurement (JIT) are maintained by the Ministry of Finance. The contract terms were revised in 2025. 

The terms and conditions take into account the requirements set for contracts in the Act on Public Procurement and Concession Contracts as well as other legislation binding on public administration. The IT contract terms of public administration are intended to be used as standard contract terms in procurement contracts between contracting entities and suppliers. The IT contract terms of public administration can be used to supplement the terms of the actual procurement contract.

The General Terms and Conditions of Public IT Procurement (JIT 2025) consist of the following contract terms:

The terms of the contract are always intended to be used in such a way that, in addition to the General Terms and Conditions (JIT 2025 - General terms), suitable special terms and conditions are used. The special terms and conditions are not intended to be used without the General Terms and Conditions, nor can the General Terms and Conditions be used without special terms and conditions suitable for the procurement.

The contract terms have been published in two parts:

JYSE/JIT Terms and Conditions for the Processing of Personal Data

The JYSE/JIT Terms and Conditions for the Processing of Personal DataLink to an external website, which consists of ‘JYSE/JIT Terms and Conditions for the Processing of Personal Data 2025’ and ‘JYSE/JIT Description of Processing Operations 2025’ (hereinafter the ‘Annex’ or ‘Annexes’) are shared annexes for use with the ‘General Terms of Public Procurement (JYSE SUPPLIES 2025 and JYSE SERVICES 2025)’ and ‘General Terms and Conditions of Public IT Procurement (JIT 2025)’.

The Annexes are meant for contracts in which the supplier (processor) will process personal data on behalf of the customer (controller) as part of the service being procured.

The ‘JYSE/JIT Terms and Conditions for the Processing of Personal Data 2025’Link to an external website  include terms and conditions for the processing of personal data. The terms and conditions are based on the EU General Data Protection Regulation. It is recommended that the terms and conditions for the processing of personal data be given precedence over other general terms and conditions in the order of application.

A separate form ‘JYSE/JIT Description of Processing Operations 2025 ’Link to an external website has also been drawn up for the processing of the personal data of the customer. The form is a template that the customer should modify to suit their contract. The form is intended to be used to describe in detail what personal data of the customer will be processed and how the supplier will process that data when providing the services under the contract. The Annex is intended for use alongside the ‘JYSE/JIT Terms and Conditions for the Processing of Personal Data 2025’.

The terms and conditions for the processing of personal data and the description of processing operations mentioned above have been drawn up as part of the update of the JYSE and JIT general terms and conditions.
